We refer to the letter from Bursa Securities dated 10 June 2020 with reference number GAI-05032020-00072 (“Letter”) which was received by the Liquidator of the Company on 12 June 2020.

Pursuant to the Company’s announcements from 17 October 2019 up to 17 March 2020 in relation to the winding-up petitions against the Company, Bursa Securities noted the Company intends to appeal against the Winding-up Order dated 15 October 2019 of which the Notice of Motion was fixed for case management on 22 November 2019.

In addition, the Board of Directors of the Sumatec was also required to update Bursa Securities on a monthly basis of any development or progress in relation to the appeal to the Court of Appeal. However, no subsequent announcements or updates were made or provided on the above-mentioned appeal and/or Notice of Motion.

In view of the above, Bursa Securities requires the Company to confirm by 24 June 2020 on whether there is any legal challenge(s)/proceedings filed against the Winding-up Order dated 15 October 2019 (including any appeal against and/or application to stay/set aside the Winding-Up Order), and if yes, the details and status of the legal challenge(s)/proceedings together with the relevant documentary evidence (“Confirmation”).

If the Confirmation is not provided to Bursa Securities by 24 June 2020, Bursa Securities shall de-list the Company pursuant to Paragraph 16.11(2)(d) of the Main LR.
