Further to the announcements made by the Company on 23 July 2020 and 27 July 2020, the Company wishes to announce that ENRA SPM Labuan Limited (“1st Plaintiff”) and ENRA SPM Sdn Bhd (“2nd Plaintiff”) (collectively “Plaintiffs”) both subsidiaries of the Company, had through their solicitors filed a Writ in Action in rem at the High Court of Sabah and  Sarawak at Kuching (“the Writ”) on 28 July 2020, against the Owner or other persons interested in the vessel known as "BRATASENA" (IMO No. 9271236) (“Vessel”)  (“Defendant”).

Details of the Writ are as follows:

1. The 1st Plaintiff’s claim against the Defendant is for damages (to be assessed), together with interest and costs, for various breaches and/or repudiatory breach of a BIMCO Standard Bareboat Charter “BARECON 2001” dated 16 October 2017 between PT CMS and the 1st Plaintiff and a Mutual Agreement on Exit Terms between the Plaintiffs, PT CMS and Sea Trust Marine Pte Ltd, a related company to PT CMS, dated 9 December 2019 and/or for the unlawful detention and/or conversion of the Vessel and/or various property on board the said Vessel that the 1st Plaintiff has ownership of and/or right of immediate possession to.
2. The 2nd Plaintiff’s claim against the Defendant is for damages (to be assessed), together with interest and costs, for the unlawful detention and/or conversion of the Vessel and/or various property on board the said Vessel that the 2nd Plaintiff has ownership of and/or right of immediate possession to. 

The Writ filed in Kuching has been fixed for case management on 28 August 2020.

The Plaintiffs’ solicitors had on 28 July 2020 informed the Plaintiffs that the Writ filed in Kuala Lumpur has been fixed for case management on 10 August 2020.

The Company will make the necessary announcements on further developments of the above matter as and when necessary.
