Isa Samad allowed to withdraw discovery application on condo suit

KUALA LUMPUR (March 22): Former Felda chairperson Tan Sri Mohd Isa Abdul Samad has withdrawn his discovery application to get further documents from FGV Holdings Bhd (FGV), namely the company's board of directors' minutes and approval for purchase of two luxury condominiums at Troika, Persiaran KLCC.

This follows FGV having given the necessary documents that Mohd Isa may need in his case following a RM7.69 million suit filed by FGV against him and its former president and group chief executive officer, Datuk Mohd Emir Mavani Abdullah. This is for the purchase of the condos at what is said to be above the market price.

Mohd Isa's lawyer Joshua Goh Shang Yi said his client had agreed to withdraw the discovery application with liberty to file again should there be a need.

"We already filed his amended defence on Tuesday (March 19). The High Court then today fixed April 18 for case management before Justice Datuk Azimah Omar," Goh said after meeting deputy registrar Farah Shuhada Ramli during case management.

Farah instructed FGV to file their reply to Mohd Isa's defence by April 2 and fixed case management on April 18. FGV was represented by Arthur Ng.

It was reported last Jan 22 that the former Felda chairperson filed the discovery application following the suit being filed against him and Mohd Emir.

Last month, it seemed that FGV would be contesting the discovery application, and Azimah had then fixed this April 12 to hear the discovery application.

With the documents given, the court allowed the withdrawal of the discovery application and the cancellation of the proposed hearing date for discovery.

FGV filed the suit on Mohd Isa and Mohd Emir last Decembr, claiming the duo had fail to discharge their "fiduciary duty, duty of fidelity and/or duty to exercise reasonable care, skill and diligence" with regard to the purchase of the condos and other matters resulting in losses suffered by the company.

FGV is seeking RM2.9 million from Mohd Isa and Mohd Emir over the condominium units and RM1.6 million over their use and possession of the units, with the duo to be jointly and severally liable to pay for these sums.

The company is also seeking RM3.14 million from Mohd Emir over the purchase of cars and RM10,837.10 over his petrol benefit, which it claimed were abused.
