Further to the announcements made on 10 May 2019, 3 June 2019, 18 July 2019 and 2 August 2019, the Company wishes to announce that the Adjudicator has delivered the Adjudication Decision under the Construction Industry Payment & Adjudication Act 2012.

The Adjudicator had awarded the following heads of claims to the Claimant:

(i)    the sum of RM2,084,636.81 being the outstanding payment due under certain payment certificates;

(ii)   the sum of RM1,651,709.60 being the amount of liquidated ascertained damages (“LAD”) which was wrongfully and unlawfully deducted by the Respondent;

(iii)  interest at the rate of 5% per annum on the outstanding payment certificates and wrongfully deducted LAD;

(iv) interest at the rate of 5% per annum on the outstanding sums based on payment/part payment of the payment certificates since the Claimant’s Payment Claim was issued for the periods set out in the Adjudication Decision.

(v) Costs in the amount of RM131,236.00 which consist of:

     - RM98,118.00; and

     - RM33,118.00 being the Claimant’s share of the Adjudicator’s fee and expenses.
