Reference is made to the Company’s announcements dated 11 December 2019 and 24 December 2019 (“Previous Announcements”). Unless otherwise stated, the terms used herein shall have the same meanings stated in the Previous Announcements.

Notice of Application to Stay the Adjudication Decision 

The hearing for the application to stay the Adjudication Decision was fixed for hearing on 27 December 2019. Upon hearing of the Parties’ submissions, the High Court of Malaya at Kuala Lumpur allowed JCSB’s application to stay the Adjudication Decision on the condition that the sum of RM574,974.07 being the adjudicated sum, interest and costs of the adjudication proceedings be deposited with Skyscape’s solicitors by 8 January 2020 with costs in the cause.

Originating Summons to Set Aside the Adjudication Decision 

With regard to the Originating Summons to set aside the Adjudication Decision, the Court has directed the Parties to exhaust affidavits in accordance with the directions given during the case management on 23 December 2019 and the Parties are directed to file written submissions by 19 February 2020.

The hearing for the Originating Summons to set aside the Adjudication Decision has been brought forward to 26 February 2020.
