We refer to the Company’s previous announcements dated 24 September 2019, 7 October 2019, 21 October 2019, 23 October 2019, 24 October 2019, 21 November 2019, 16 December 2019, 31 December 2019 and 7 January 2020 (“Announcements”). Unless otherwise stated, the terms used throughout this announcement shall have the same meanings as defined in the Announcements.

The Company wishes to announce that the case management set for 6 January 2020 took place before YA Tuan Atan Mustaffa Yussof Ahmad in regard to Kuwait Finance House (Malaysia) Berhad’s Writ of Summons and Statement of Claim dated 20 September 2019.

The High Court has been notified that the Winding Up Court has allowed The Bank of Nova Scotia Berhad’s application to substitute the Petitioner, Desa Potensi Sdn Bhd for the Winding Up Petition against the Company and now, the Amended Petition (Petition No.: WA-28NCC-950-09/2019) filed by The Bank of Nova Scotia Berhad is fixed for hearing on 13 January 2020.

The High Court then fixed the matter for case management on 20 January 2020 to update the status.

Further announcement on the development of the above matter will be made to Bursa Malaysia Securities Berhad in due course.
