We refer to the Company's announcements made on 19 July 2019, 09 August 2019, 18 September 2019, 22 January 2020, 11 March 2020 and 29 May 2020 in relation to the writ and statement of claim commenced by APFT Berhad (“APFT”) against Dato’ Faruk Bin Othman (“1st Defendant”), Arif Bin Faruk (“2nd Defendant”), Tan Boon Leng (“3rd Defendant”) and Tan Nyap Keong @ Tony Tan (“4th Defendant”). Unless otherwise stated, the terms used throughout this announcement shall have the same meanings as defined in the earlier announcements.

As previously announced, the trial of Suit 399 was scheduled from 1st to 4th September 2020.

The trial of Suit 399 proceeded on 1st and 2nd September 2020 as scheduled.

On 3rd September 2020, all the parties in Suit 399 recorded a consent judgment (“Consent Judgment”) before the Kuala Lumpur High Court to resolve Suit 399. The terms of the Consent Judgment are as follows:-

A. The return/transfer of balance debt in the sum of RM2,853,842.57 to Asia Pacific Flight Training Sdn Bhd by APFT without being subjected to interest by way of APFT’s Resolution dated 4.1.2018 is valid and proper;

B. There is no debt due and owing by APFT to the 1st Defendant; and

C. No order as to costs.
