We refer to the announcements issued on 25 February 2019, 6 March 2019, 9 April 2019, 18 April 2019, 3 May 2019, 23 May 2019, 3 June 2019, 21 June 2019, 31 July 2019, 20 August 2019, 8 October 2019, 20 December 2019, 21 January 2020, 17 February 2020, 28 February 2020, 3 March 2020, 1 April 2020, 9 April 2020, 19 May 2020, 15 June 2020, 15 July 2020, 3 September 2020, 13 October 2020, 22 October 2020, 16 November 2020, 6 January 2021,11 January 2021, 17 February 2021, 19 March 2021 and 24 May 2021 in relation to the abovesaid Construction Court Suit and Civil Court Suit (“Announcements”). Unless otherwise stated, the terms used herein shall have the same meanings stated in the Announcements.

The Company wishes to announce the following updates for the Civil Court Suit and Construction Court Suit.

Civil Court Suit

In light of the MCO 3.0 imposed starting from 1 June 2021, the Court has on 31 May 2021 informed that the trial originally fixed on 14 June 2021 to 16 June 2021 will be adjourned and converted into virtual case management. The new trial dates to be decided and informed by the Court later.

Construction Court Suit

Further to announcement made on 24 May 2021, the Company wish to inform that the winding up petition against the 2nd Defendant is under Shah Alam High Court (“Winding up”) – Suit No. BA-28NCC-236-05/2021 between Cabnet Systems (“Petitioner”) and Rimarisan (“Respondent”) (“Winding Up Suit”).

The Winding Up is based on the Judgment dated 18 December 2019 obtained by the Company in the Construction Court Suit which was upheld on appeal by the Court of Appeal on 17 March 2021. As the matter in respect of Construction Court Suit have concluded, there shall be no further announcement pertaining to the Construction Court Suit.

Any further material developments to the Civil Court Suit will be announced as and when these developments materialise.
