The Board of Directors of the Company wishes to announce that its wholly owned subsidiary, Khee San Food Industries Sdn Bhd (Interim Judicial Manager appointed) (“Defendant”) had on 13 April 2022 been served with a sealed Writ of Summons dated 15 March 2022 filed by Messrs. Azrul Afifi & Azuan on behalf of Export-Import Bank of Malaysia Berhad and Resource Food Supplies (M) Sdn Bhd (“Plaintiffs”).

The 1st Plaintiff, Export-Import Bank of Malaysia Berhad is a government owned Development Financial Institution with its registered address at Tingkat 16, EXIM Bank, Jalan Sultan Ismail, 50250 Kuala Lumpur.

The 2nd Plaintiff, Resource Food Supplies (M) Sdn Bhd is a private limited company incorporated in Malaysia under the Companies Act 1965 with its business address at Lot No. 2, Jalan Tiang U8/92, Taman Perindustrian Bukit Jelutong, Seksyen U8, 40150 Shah Alam, Selangor.

The details of the claim are as follows:

i. The outstanding sums of RM426,860.00 that has yet to be paid by the Defendant for goods sold and delivered by the 2nd Plaintiff to the Defendant;

ii. Interest at the rate of 5% per annum on the outstanding sums calculated from 15 March 2022 to the date of full settlement;

iii. Costs of this course of action; and

iv. Such further and/or other reliefs deemed fit by the Court.

The Company will make the necessary announcements to Bursa Malaysia Securities Berhad as and when there are further developments in relation thereof and/or upon receipt of any further directions by the Court.
