The Board of Directors of Seacera Group Berhad ("the Company") wishes to announce that the Company had filed an Originating Summon ("OS") against Ismail bin Othman ("IO") and the claims are as follow: a) A declaration that statutory notice dated 11 April 2022 issued under Section 466 of Companies Act 2016 by the Defendant ("DF") to the Plaintiff ("PF") and the winding up proceeding are abuse of Court process; b) A Fortuna Injunction which restrains the DF either by himself and/or his solicitors and/or his agents, from issuing/filing a winding up petition in any High Court in Malaysia against the PF pursuant to the DF’s statutory notice and/or the claimed amount as stated in DF’s statutory notice; c) Costs; and d) Such other relief as the Court may deem fit. Please be also informed that the Court granted an Ad Interim Injunction via PF’s ex-parte application pending disposal of this OS. The Court fixed a hearing date for the OS on 16 June 2022.
