MATERIAL LITIGATION PURSUANT TO PARAGRAPH 9.04(F) OF THE BURSA MALAYSIA SECURITIES BERHAD MAIN MARKET LISTING REQUIREMENT

We refer to the announcements dated 22 February 2022, 7 March 2022, 24 March 2022, 31 March 2022, 15 April 2022, 9 May 2022, 20 May 2022, 31 May 2022, 7 June 2022, 14 June 2022, 30 June 2022, 5 July 2022, 15 July 2022, 19 July 2022, 26 July 2022, 2 August 2022, 9 August 2022, 16 August 2022, 23 August 2022, 30 August 2022, 6 September 2022, 13 September 2022, 15 September 2022 and 22 September 2022 ("Announcements") in relation to the fire incident case filed by Jaksa Penuntut Umum Negeri Sintang, Indonesia (“Public Prosecutor”) against PT Rafi Kamajaya Abadi ("PTRKA").

Unless otherwise stated, the definitions used herein shall have the same meanings as set out in the Announcements.

The Board of Directors of TDM Berhad wishes to announce that TDM Berhad has been informed by its Indonesian subsidiary, PTRKA that the Court of Sintang had on 10 October 2022 delivered its decision on the case.

The Court of Sintang had on 10 October 2022 imposed a penalty of IDR2,000,000,000.00 (approximately RM606,206.00) under Article 99(1) of Laws No. 32 year 2009 on Environmental Protection and Management against PTRKA.

The decision has no material financial and operational impact against PTRKA, the Company and the Group.  

The Company was also informed that PTRKA is consulting its legal counsel to file an appeal against the above decision.
