Telekom Malaysia Berhad (“TM” or “Respondent”) refers to its announcement dated 13 February 2023 regarding the filing of the Statement of Claim dated 10 February 2023 by MYTV Broadcasting Sdn Bhd (“MYTV” or “Claimant”) at the Asian International Arbitration Centre (Reference No. GA1-13022023-00058). The aforesaid announcement is made subsequent to the receipt of the Notice of Arbitration (Notice) from MYTV as announced on 25 February 2022 and the filing of the Response to the said Notice by TM on 25 March 2022 and duly announced on the same date. 

In regards to the 2nd relief sought by MYTV:

1. Sections 55, 56, 104(2) and 106 of the Communications and Multimedia Act 1998 (“the CMA”) stipulates that the Malaysian Communications and Multimedia Commission (MCMC) is empowered to make a determination on any matter specified in the CMA;
2. MYTV is seeking a declaration that the Mandatory Standard on Access Pricing, as determined by the MCMC pursuant to the above Sections of the CMA, is applicable to the services provided by TM to MYTV under the Service Agreement for the provision of Digital Terrestrial Television (DTT) Broadcasting Infrastructure, Network Facilities and Related Services dated 14 November 2016.

TM will strenuously oppose the claims made by MYTV in the Statement of Claim and shall in due course submit its Statement of Defence and Counterclaim to the Arbitral Panel by 10 May 2023 as per the agreed Procedural Timeline.

As the dispute is still in the preliminary stage of the arbitration process, TM is unable to assess with reasonable certainty at this juncture whether the claims made by MYTV in the Statement of Claim will have any material impact on TM’s financial position or operations. TM will be in a better position to evaluate this once MYTV has adduced the relevant evidence to substantiate their claim and upon TM receiving advice from its solicitors.
