Cover Story: Who are YWP’s donors?

IN 2016, Yayasan Wilayah Persekutuan (YWP) received a total of RM10.45 million from eight donors. This was revealed in a written reply by Federal Territories Minister Khalid Samad last month to a question from Lembah Pantai MP Ahmad Fahmi Mohamed Fadzil. The foundation did not receive any contribution from 2017 to the present.

Incidentally, at least three of the donors — Euro Saga Sdn Bhd, Pertama Makmur Sdn Bhd and Tekad Warisan (M) Sdn Bhd — were awarded tenders by Dewan Bandaraya Kuala Lumpur (DBKL) in January 2016. Is it just a coincidence?

Note that the FT minister is also YWP chairman and the Kuala Lumpur mayor also sits on the board. In Datuk Seri Tengku Adnan Tengku Mansor’s ongoing bribery trial, the High Court heard on July 4 that DBKL prioritised instructions from the FT minister.

Did the donations play a role in the decision by DBKL to award the tenders to the donors?

Apart from the 2016 tender, Euro Saga won another job from DBKL in March 2018, valued at RM92.3 million.

A search on the Companies Commission of Malaysia’s (SSM) website reveals that Euro Saga is a civil and building contractor whose shareholders are Hamidah Ibrahim (50%), Hasniruddin Hassim (25%) and Izzuan Hairi Asfarizal Bahari (25%). Euro Saga donated RM1.3 million to YWP.

Another donor, Pertama Makmur, was described as a trader in construction-related products and building construction contracts. The shareholders are Noor Jan Baharom (52.63%), Meor Shafie Mior Hussain (23.68%) and Md Khir Yaacob (23.68%).

Meanwhile, Tekad Warisan’s shareholders are Ernie Luhiman and Khairul Firdaus Akhbar Khan, who equally own the company.

It is unclear if one of the listed donors, Low Keng Huat, is linked to a project undertaken by YWP with a company called Tanda Warisan Sdn Bhd. Tanda Warisan is 80% owned by Huatland Development Sdn Bhd, which is wholly owned by Low Keng Huat Bhd, which in turn is owned by Consistent Record Sdn Bhd. YWP did not respond to questions on what its dealing with Tanda Warisan were.

Some would find it ironic that YWP received RM5 million — the single biggest donation in 2016 — from another foundation, Yayasan Albukhary, which is linked to Tan Sri Syed Mokhtar Albukhary.

The people behind donor Carpet Corp Sdn Bhd are Deepak Jaikishan Jaikishan Rewachand (33.33% plus 1 share), Rajesh Jaikishan (33.33%) and Dhanesh Jaikishan Rewachand (33.33%). Deepak and his brother Rajesh are suing Datuk Seri Najib Razak and his wife Datin Seri Rosmah Mansor for RM52.6 million in damages for directly and indirectly conspiring to damage his business.

On the list of donors was another construction firm, Asianmax Corp Sdn Bhd, which gave RM1.6 million to YWP. The shareholders are Datuk Soo Sze Ching (60%), Soo Pat Li (16%) and Lim Yoke Eng (24%). In April, it was reported that Sze Ching, the largest shareholder of Sinotop Holdings Bhd, planned to inject Asianmax Corp into the listed entity for RM96 million.

A company called Genting Sdn Bhd was also named. However, there is no record of the company on the SSM website.
