Appeal court quashes Taman Rimba Kiara development order

PUTRAJAYA (Jan 27): The Court of Appeal today quashed a development order by the Kuala Lumpur City Hall (DBKL) to develop the Taman Rimba Kiara (TRK) by Memang Perkasa Sdn Bhd, a subsidiary of Malton Bhd.

The Court of Appeal panel comprising three judges, led by Federal Court Judge Datuk Mary Lim Thiam Suan, unanimously decided that the Development Order obtained in 2017 by the joint venture of Yayasan Wilayah Persekutuan and Developer Memang Perkasa Sdn Bhd for the TRK project is null and void.

In doing so, she set aside the High Court’s decision on Nov 28, 2018 which dismissed the resident’s bid to stop the proposed mixed development project in TRK.

The three-judge bench also include Datuk Has Zanah Mehat and S Nantha Balan.

In 2014, Yayasan Wilayah Persekutuan (YWP) entered into a joint venture with Memang Perkasa Sdn Bhd, a subsidiary of Malton Bhd to develop a 25-acre site at TRK. TTDI residents had protested against the proposed eight blocks of high-end serviced apartments and one block of affordable housing apartments which had gained conditional planning permission and development order by DBKL.

Following protests by TTDI residents, the then federal territories minister Khalid Samad had proposed a scaled-down development plan to comprise four blocks of serviced apartments and 204 affordable housing units.
