(Unless otherwise stated, all references, abbreviations and definitions used in this announcement shall have the same meaning as those defined in the announcement dated 3 March 2023, 30 March 2023, 18 May 2023, 22 May 2023, 1 June 2023, 21 June 2023, 21 July 2023, 2 August 2023, 16 August 2023, 4 September 2023, 18 October 2023, 10 November 2023, 10 January 2024 and 29 January 2024).

Reference is made to the above matter and our announcement on 29 January 2024.

The Board of the Company wishes to announce the following outcomes resulted from the case management for Enclosure 1 held on 11 March 2024:-

1. Parties confirm that all pleadings for the main suit, the Company’s, KUB Realty’s and KUBAH’s counterclaim and BPSB’s 3rd Party Proceedings have been exhausted; and

2. PTG Johor and Pejabat Tanah Daerah Kluang (“PTD Kluang”) in the Company’s, KUB Realty’s and KUBAH’s counterclaim have not entered appearance and the same was raised during the case management. Solicitor for PTG Johor and PTD Kluang sought leave to file their memorandum of appearance. There were no objections.

The Court further gave the following directions:-

1. Parties to proceed with preparation of Pre-Trial Documents (“PTD”):-

• Bundle of Pleadings;
• Common Bundle of Documents;
• Summary of Case;
• Statement of Agreed Facts;
• Statement of Agreed Issues to be Tried; and
• List of Witnesses.

2. Next case management is fixed on 11 June 2024 for the following items:-

• to update the Court on the preparation of the PTD; and
• to fix dates for Trial.

3. No directions on interlocutory applications.

Further updates on any material development of the case will be made from time to time.
