The Board of Directors of Classita wishes to inform that Caely (M) Sdn Bhd, a wholly-owned subsidiary of the Company (“Caely-M” or “Plaintiff”) had, on 11 August 2025 served a Writ of Summon dated 11 August 2025 and Statement of Claim issued by the High Court of Malaya at Ipoh (Civil Suit No. AA-22NCvC-69-08/2025) to Koperasi Peserta-Peserta Felcra Malaysia Berhad (“Defendant”) for recovery of the outstanding sum due and owing by the Defendant.

Particulars of claim and circumstances leading to filing of the Writ of Summon and Statement of Claim

The Defendant had, on 15 February 2013 appointed Caely-M as the contractor for the housing project known as Kampung Tersusun Generasi Kedua FELCRA Berhad Seberang Perak, Changkat Lada, Mukim Pasir Salak, Kampung Gajah, Perak under the Contract BGNWK 28/2013 for a total contract sum of RM69,041,690 upon such terms and conditions stipulated therein. On 03 October 2022, Caely-M had completed and delivered the project to the Defendant. The total outstanding sum due from the Defendant as at 05 July 2023 is RM9,469,297.33 (“Outstanding Amount”).

The Plaintiff had through a firm of lawyers acting on its behalf issued a Notice of Demand dated 23 June 2025 to the Defendant demanded the Outstanding Amount. The Defendant had neglected, refused and failed to pay the Outstanding Amount.

The Plaintiff seeks against the Defendant for the following:

1)       the outstanding sum of RM301,996.00 being the payment for the sample house construction;

2)       the outstanding sum of RM9,167,301.33 as at 05 July 2025;

3)       interest at the rate of 5% per annum on the Outstanding Sum from date of judgement until the date of full settlement;

4)       costs; and

5)       other relief that the Honourable Court deems fit and proper to grant.

Financial and Operational Impact

The above will not have any financial or operational impact on Group.

Expected losses to the Group, if any

The Group does not expect any losses from the above except for the legal expenses.
