The Board of MUIP wishes to announce that its 60%-owned subsidiary company, West Synergy Sdn Bhd ("WSSB"), has on 25 March 2026, commenced an action in the Shah Alam High Court to set aside the Adjudication Decision dated 9 March 2026 and the Corrected Adjudication Decision dated 12 March 2026 (collectively, "Adjudication Decisions") pursuant to Section 15(b) of the Construction Industry Payment and Adjudication Act 2012 ("CIPAA") ("Setting Aside Application"). In this action, WSSB is the named Plaintiff and the named Defendant is Nine Hundred Builders Sdn Bhd ("NHB").
Pursuant to the Adjudication Decisions, the adjudicator has directed that WSSB is to pay NHB (i) the sum of RM1,486,478.57 which consists of uncertified sums for works done and variation works and interest on the said sum; and (ii) the sum of RM65,076.54 being costs of the adjudication.
In the Setting Aside Application, WSSB is seeking an order that the whole of the Adjudication Decisions be set aside pursuant to Section 15(b) of CIPAA and that costs of and incidental to the said action be paid by the Defendant to the Plaintiff. The Setting Aside Application is filed on the basis that the adjudicator did not consider the positions canvassed by WSSB in respect of its set-offs and that WSSB was not given the opportunity to ventilate its case fully in the adjudication proceedings.
WSSB has also filed an application to, amongst others, stay the Adjudication Decisions pending the disposal of the Setting Aside Application pursuant to Section 16 of CIPAA ("Stay Application").
This Setting Aside Application and/or the Stay Application is not expected to have any material financial and operational impact on the Group. The Company will make the necessary announcement to Bursa Malaysia Securities Berhad as and when there is a material development on the matter.
