Further to the announcements made on 25 August 2020, 5 October 2020, 11 March 2021 and 20 January 2022, the Board of Directors of Deleum Berhad (“the Company”) wishes to announce the updates in relation to the suit commenced by Synergy Spectacular Sdn. Bhd. (“SSSB”) against Deleum Primera Sdn. Bhd. (“Deleum Primera”), a 86.67 % owned indirect subsidiary of the Company, vide Kuala Lumpur High Court Civil Suit No. WA-22NCvC-508-08/2020 (“the Suit”).

Pursuant to the Decision delivered by the Court on 20 January 2022, SSSB has filed Civil Appeal No. W-02(NCvC)(W)-334-02/2022 (“the Appeal”) at the Court of Appeal.

At the Case Management on 7 July 2022, SSSB’s solicitors informed the Court of Appeal that SSSB has been wound up and that they are in the process of applying for the sanction of the Director General of Insolvency of Malaysia (“DGI”) to proceed with the Appeal.

Pursuant to the above, the Company’s solicitors conducted a winding-up status search on SSSB confirming that SSSB was wound up on 27 May 2022.

Subsequently, on 13 July 2022, the Court of Appeal has fixed the Appeal for further Case Management on 3 October 2022 for SSSB’s solicitors to update the Court on the status of the sanction from the DGI.

In the event that the required sanction to continue with the Appeal is obtained, the Appeal will proceed and the same has been tentatively fixed for Hearing before the Court of Appeal on 12 January 2023.
