Reference is made to the Company's announcement dated 28 October 2022.
The Board of Directors of the Company wishes to clarify that the originating summons filed by KTCCMSB against TCSCSB are for the following orders: -
1) A declaration that KTCCMSB has no obligations to make payment to TCSCSB on behalf of MPM Project Management pursuant to Section 30 of the Construction Industry Payment and Adjudication Act 2012 ("CIPAA 2012") and / or the Letter of Undertaking dated 19 September 2018;
2) A declaration that TCSCSB's notice to KTCCMSB dated 21 September 2022 issued pursuant to Section 30 of the CIPAA 2012 is defective;
3) Costs to be borne by TCSCSB; and
4) Any further or other relief the Honourable Court deems fit and / or necessary.
