MATERIAL LITIGATION PURSUANT TO PARAGRAPH 9.04(F) OF THE BURSA MALAYSIA SECURITIES BERHAD MAIN MARKET LISTING REQUIREMENT

We refer to the announcements dated 22 February 2022, 7 March 2022, 24 March 2022, 31 March 2022, 15 April 2022, 9 May 2022, 20 May 2022, 31 May 2022, 7 June 2022, 14 June 2022, 30 June 2022, 5 July 2022, 15 July 2022, 19 July 2022, 26 July 2022, 2 August 2022, 9 August 2022, 16 August 2022, 23 August 2022, 30 August 2022, 6 September 2022, 13 September 2022, 15 September 2022, 22 September 2022, 11 October 2022 and 31 October 2022 ("Announcements") in relation to the fire incident case filed by Jaksa Penuntut Umum Negeri Sintang, Indonesia (“Public Prosecutor”) against PT Rafi Kamajaya Abadi ("PTRKA").

The Board of Directors of TDM Berhad wishes to announce that TDM Berhad has been informed by its Indonesian subsidiary, PTRKA that the Pengadilan Tinggi Pontianak has delivered its decision on the appeal.

The Pengadilan Tinggi Pontianak upheld the decision of Pengadilan Negeri Sintang that PTRKA is guilty and liable to a fine of IDR2,500,000,000.00 (approximately RM707,814) and a cost of IDR5000.00 (approximately RM1.50).

The decision has no material financial and operational impact against PTRKA, the Company and the Group.  

The Company was also informed that PTRKA is filing an appeal against the above decision to Mahkamah Agung in Jakarta, Indonesia.
