The Board of Directors of ATA IMS Berhad (“ATAIMS” or “the Company”) wishes to announce that on 9 June 2024, its wholly owned subsidiary ATA Industrial (M) Sdn Bhd (“Plaintiff” or “AIM”) had obtained an (ex-parte) Interlocutory Injunction against Shinano Kenshi Co. Ltd. (“Defendant” or “Shinano”) from the Johor Bahru High Court to restrain the Defendant from presenting any petition pursuant to Sections 465 and 466 of the Companies Act 2016 to wind up the Plaintiff, or in the event the Defendant has already presented a winding up petition against the Plaintiff, to restrain the Defendant from proceeding with the winding up petition, including advertising and/or gazetting the same. In connection with this injunction, an Originating Summons number JA-24NCC-19-06/2024 was also filed. The injunction will be pending the hearing and decision of the Originating Summons.
