Reference is made to PESTEC’s announcements made on 27 June 2023, 3 July 2023, 7 July 2023, 20 July 2023, 3 August 2023, 7 September 2023, 8 January 2024, 10 January 2024, 14 May 2024, 12 September 2024 and 24 October 2024, in relation to the filing of an appeal by Syarikat Pembenaan Yeoh Tiong Lay Sdn. Bhd. (“SPYTL”) against the High Court’s decision to dismiss SPYTL’s application for stay of proceedings pending arbitration against PESTECH Sdn. Bhd. (“PSB”) [“SPYTL’s Stay Appeal”]. The proceeding is in relation to the main suit before the High Court between PSB and SPYTL for a claim in detinue for, amongst others, immediate possession of machineries belonging to PSB and damages for wrongful detention and use of the same.

The Board of Directors of PESTEC wishes to announce that during the hearing at the Court of Appeal held on 26 March 2025, the Learned Judge had fixed for case management on 14 April 2025 to fix the hearing date in May 2025. The Court of Appeal will make the decision after the outcome of the Anti Arbitration Injunction Application filed by PESTEC and PESTECH Technology Sdn Bhd and Arbitration Stay Application filed by SPYTL.
