The power is with DNEX. As long as DNex dont issue the ICPS, Mimas cant buy the ICPS thus cant buy the shares. Silterra will remain be a 60% subsidiary of DNex and the license is thus valid. DNex can always use other methods to raise the 100mils(bonds, PP, loan etc). Mimas is just trying to get the controlling stakes in Silterra. I see no benefit for both parties if the Silterra operating license is void. So I personally think that Mimas will eventually accept the original 40% deal.
